Minors 15 and under may not work before 7 a.m. or after 7 p.m. before a school day, more than 15 hours in a school week or 3 hours on a school day, or, during holidays and summer, before 7 a.m., after 9 p.m., more than 8 hours a day or 40 hours a week.

For more than 15 hours in any one week when school is in session. (b) On any school day, minors 15 years of age or younger who are not enrolled in a career education program may not be gainfully employed for more than 3 hours, unless there is no session of school the following day. (c) During holidays and summer vacations, minors 15 years of age or younger may not be employed, permitted, or suffered to work before 7 a.m. or after 9 p.m., for more than 8 hours in any one day, or for more than 40 hours in any one week.

Before suing for unpaid minimum wages, the worker must give the employer written notice of the claim, and the employer then has 15 calendar days to pay or resolve it.

Any person aggrieved by a violation of this section may bring a civil action in a court of competent jurisdiction against an employer violating this section or a party violating subsection (5). However, prior to bringing any claim for unpaid minimum wages pursuant to this section, the person aggrieved shall notify the employer alleged to have violated this section, in writing, of an intent to initiate such an action. The notice must identify the minimum wage to which the person aggrieved claims entitlement, the actual or estimated work dates and hours for which payment is sought, and the total amount of alleged unpaid wages through the date of the notice. (b) The employer shall have 15 calendar days after receipt of the notice to pay the total amount of unpaid wages or otherwise resolve the claim to the satisfaction of the person aggrieved. The statute of limitations for bringing an action pursuant to this section shall be tolled during this 15-day period. If the employer fails to pay the total amount of unpaid wages or otherwise resolve the claim to the satisfaction of the person aggrieved, then the person aggrieved may bring a claim for unpaid minimum wages, the terms of which must be consistent with the contents of the notice.

Covered non-exempt employees must be paid at least 1.5 times their regular rate for hours worked over 40 in a workweek; federal law sets no daily overtime and no weekend or holiday premium. (non-exempt employees covered by the FLSA)

Unless specifically exempted, employees covered by the Act must receive overtime pay for hours worked in excess of 40 in a workweek at a rate not less than time and one-half their regular rates of pay. There is no limit in the Act on the number of hours employees aged 16 and older may work in any workweek. The Act does not require overtime pay for work on Saturdays, Sundays, holidays, or regular days of rest, as such.

Florida's minimum wage is set by the state constitution (art. X, § 24, voter-approved 2004 and 2020), so rows use basis ballot_measure. $1.00 annual steps each September 30 from $10.00 (2021) to $15.00 (September 30, 2026); from 2027 FloridaCommerce calculates a CPI-W adjustment each September 30 that takes effect the following January 1 (first on January 1, 2028; no figure published yet). Tipped employees - the employer tip credit is frozen at the 2003 FLSA tip credit ($3.02), so the cash wage is the minimum wage minus $3.02. 2009-2021 CPI history, the $11/$12/$13 steps (2022-2024) and the $11.98 tipped cash wage from September 30, 2026 are not yet sourced. Enforcement is by private action or the Attorney General.
