Overtime
Employers must pay 1.5 times the regular rate for hours over 40 in a workweek, or over 52 hours for qualifying seasonal amusement or recreation businesses. (non-exempt employees; employees exempt from federal overtime are also exempt in Missouri)

1. No employer shall employ any of his employees for a workweek longer than forty hours unless such employee receives compensation for his employment in excess of the hours above specified at a rate not less than one and one-half times the regular rate at which he is employed. 2. Employees of an amusement or recreation business that meets the criteria set out in 29 U.S.C. 213(a)(3) must be paid one and one-half times their regular compensation for any hours worked in excess of fifty-two hours in any one-week period.

Unless the director grants a written waiver, a child may not work more than 3 hours on a school day, 8 hours on a non-school day, or 6 days or 40 hours in a week, may not start before 7 a.m., and may not work after 7 p.m. from Labor Day to June 1 or after 9 p.m. from June 1 to Labor Day. 1. A child shall not be employed, permitted or suffered to work at any gainful employment for more than three hours per day in any school day, more than eight hours in any nonschool day, more than six days or forty hours in any week. The provisions of this subsection may be waived by the director, in full or in part, depending upon the nature of the employment. Recovering unpaid wages
Employees paid less than Missouri minimum wage or overtime law requires can sue for the unpaid wages plus liquidated damages of twice that amount, costs and attorney fees, within three years.

Any employer who pays any employee less wages than the wages to which the employee is entitled under or by virtue of sections 290.500 to 290.530 shall be liable to the employee affected for the full amount of the wage rate and an additional amount equal to twice the unpaid wages as liquidated damages, less any amount actually paid to the employee by the employer and for costs and such reasonable attorney fees as may be allowed by the court or jury. The employee may bring any legal action necessary to collect the claim. Any agreement between the employee and the employer to work for less than the wage rate shall be no defense to the action. All actions for the collection of any deficiency in wages shall be commenced within three years of the accrual of the cause of action.

Mo. Rev. Stat. § 290.502. CPI-W indexed each January 1 through 2024 (Prop B 2006), stepped schedule 2019-2023 (Prop B 2018), Proposition A (2024) steps for 2025 and 2026. H.B. 567 (2025, effective Aug 28, 2025) ended indexing after 2026, so no increase is scheduled. Retail or service businesses with annual gross income under $500,000 are exempt from the state rate (federal rules apply). Tipped cash wage is 50% of the rate.
