Overtime

Employers must pay 1.5 times the employee's wage rate for hours over 40 in a workweek; employers grossing less than $150,000 a year are exempt from Ohio's overtime rule. (non-exempt employees of employers grossing $150,000 or more a year)

Tips

Tipped employees (those who customarily receive more than $30 a month in tips) may be paid $5.50 an hour plus tips in 2026, but an employer using the tip credit must be able to show that cash wage plus tips reaches at least the full minimum wage. (tipped employees)

Ohio Const. art. II, § 34a (2006) indexes the rate to CPI-W every January 1 and applies it to employers above an indexed annual gross receipts threshold ($405,000 for 2026); smaller employers and employees under 16 get the federal rate. Tipped cash wage is half the state rate. Rates before 2026 are not yet in the dataset.
